The terms and conditions provided below govern your use of vetjourney.com and all related sites and domains and their features operated by Vet Journey, LLP, DBA Vet Journey (“Vet Journey”) (the “Website”). BY USING OR ACCESSING THE WEBSITE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS. If you fail to comply with these terms and conditions, your permission to use the Website automatically terminates and Vet Journey (“Vet Journey,” “us,” “we”) may terminate your use of the Website, block or otherwise bar you from future usage of the Website, and take any other action we deem necessary and appropriate, whether in law or in equity.
Vet Journey may use third-party providers to provide services to clients. In using the Website, you agree that your relationship is solely with Vet Journey and not with any other provider, and Vet Journey is solely responsible for the operation of the Website, subject to the terms and conditions set forth herein. By accessing and/or using any content, information, service, software, product, or materials on the Website (hereinafter referred to individually and collectively as the “Services”), you represent and warrant that you are able to form a binding contract with us and that such contract is formed between us and you by your use of the Website, and you acknowledge that you have read and agree to follow and be bound by the following terms of service (“TOS”) and the Vet Journey Privacy Policy, which can be found on the Website and is incorporated herein by this reference (the “Privacy Policy”).
If you are an advertiser, sponsor, attendee, exhibitor, employer, recruiter, or other customer of Vet Journey, these TOS are in addition to any terms and conditions (including, but not limited to payment terms) that you may agree to in that capacity. You agree that Vet Journey websites that are not powered by other providers are not governed by these TOS and may have separate terms of service. You are prohibited from using the Services or registering for a Vet Journey account if you do not accept the Privacy Policy and agree to be bound by the TOS. Registration for a Vet Journey account and use of the features of the Website is restricted to those individuals over 18 years of age who are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations and warranties herein. By registering or participating in services or functions on the Website, you represent that you are over 18 years of age and have the capacity to enter into the terms herein. In any case, the Website is not for use by people under 18. If you are under 18 years of age, do not use the Website.
MODIFICATION TO TERMS
Vet Journey reserves the right to update and change these TOS and the Privacy Policy from time to time without notice to you. Your use of any new features that augment or enhance the Services, including the release of new tools and resources, shall be subject to the TOS in effect at the time of such use and continued use of the Services after any changes to the TOS shall constitute your consent to all such changes.
GENERAL CONDITIONS
You understand that Vet Journey operates this Website and provides the Services to facilitate, through the Website, the direct, person-to-person introduction of bona fide Registrants seeking employment, educational or franchising opportunities to those offering or seeking to provide such opportunities (the “Intended Purpose”). Any use of the Website or any information, including, without limitation, contact information on the Website for any purpose other than the Intended Purpose shall constitute a violation of these TOS and may, at our sole discretion, lead to removal of you from the Website and revocation from you of some or all of your user privileges. Any conduct or interaction on the Website that appears, in our sole discretion, to be discourteous, disrespectful, distracting, discriminatory, vulgar, or not focused primarily on the Intended Purpose may result in the suspension or termination of a registrant’s account. By way of example, but not of limitation, use of the Website to make social connections with other registrants, to make position or opinion statements, to debate any issue or to engage with others in any manner that creates offense or controversy in public areas of the Website or disrupts the event experience for others is contrary to the intended purpose. Vet Journey reserves the right at all times to determine, in its sole discretion, whether particular conduct conforms to the intended purpose of an event and to terminate your use of the Website, without further obligation of any sort to you, should it determine that your conduct is nonconforming in this respect.
You agree that you will use the services and the Website only for the intended purpose and not for any illegal purposes. You agree that, in using the services and the Website, you will not misrepresent your identity or intentions, modify or delete any email or communication headers or packet identifying information so as to hide or misrepresent your identity, register for an account or attend any chat session under a false identity or pseudonym or for purposes other than the Intended Purpose, or modify, adapt or hack the Website in any manner whatsoever. You agree that you will not use the services or the Website in any manner that could damage, disable, overburden and/or impair any Vet Journey server or the network(s) connected to any Vet Journey server, and/or that you will not interfere with any other party’s use and enjoyment of the Website. If your account is terminated for any reason or your user privileges suspended, terminated, or revoked for any reason, any subsequent registration by you for any Vet Journey event or any use by you of the Website or the Services without the express, written permission of Vet Journey and reinstatement by Vet Journey of your account privileges is a breach of these TOS.
Your failure to follow any reasonable instruction related to these TOS given you by Vet Journey will result in immediate account termination and may, in Vet Journey’ s sole discretion, result in suspension, termination, or revocation of your user privileges and/or your registration and/or result in legal action against you.
You agree not to deep-link to the Website or access the Website manually or with any robot, spider, web crawler, extraction software, automated process or device to scrape, copy or monitor any portion of the Website or any materials or other content on the Website without express written permission from Vet Journey. You agree not to reproduce, duplicate, copy, sell, re-sell or exploit any portion of the Website or the services except as provided herein without the express written permission by Vet Journey.
You understand that the technical processing and transmission of the Website, including, without limitation, any information or content that you provide while using the Website, may be transferred unencrypted and involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. You agree to not upload, post, host, or transmit “spam” messages via the Website or to any party with whom you have been introduced via the Website. You agree to not transmit worms or viruses or any destructive code to Vet Journey, to the Website, or to any party with whom you have been introduced via the Website.
Vet Journey offers various informational and alert notifications sent via text message or email such as outage notifications, and usage details . We will also offer marketing messages that will inform you of new or enhanced Vet Journey products and services. Enrollment in this Service requires you to voluntarily provide your mobile phone number with an area code within the United States, including the District of Columbia. You may be asked to verify your mobile phone number or email address before the SMS Service will start. This may require responding to a text message sent to your mobile phone, or an email sent to confirm your enrollment in this SMS Service.
Termination of SMS Service by You. You understand, acknowledge and agree that you may opt out of this SMS Service at any time, but only via the following methods. To stop receiving text messages under this SMS Service you must text “STOP” to the number from which you are receiving our text message notification. To opt-out of receiving email messages, you must follow the unsubscribe instructions in our email notifications. If you are an existing Vet Journey customer and you unsubscribe from the SMS Service, you understand, acknowledge and agree that we may continue to contact you via text messages or emails regarding administrative or informational purposes related to the Services and accounts (including follow-up messages regarding your account, billing and service issues) using the contact information you voluntarily submitted at the time you signed up for any Vet Journey Service(s). By law, such messages are not considered to be commercial messages.
Termination of SMS Service by Vet Journey. Vet Journey reserves the right, in its sole discretion, to suspend or terminate the SMS Service at any time, in whole or in part, for any reason, with or without notice to you.
FOR BUSINESSES AND CLIENTS
AGREEMENT TO PAY
You agree to timely pay in full for all products and services you purchase from Vet Journey, including, without limitation, those products and services you purchase through the Website. YOU ARE RESPONSIBLE FOR THE TIMELY PAYMENT OF ALL FEES AND CHARGES AND FOR PROVIDING VALID PAYMENT INFORMATION.
RIGHT TO CHANGE PRICES AND AVAILABILITY OF PRODUCTS
Vet Journey reserves, at all times, the unilateral right to change the prices and availability of products and services without advance notice to you.
ELECTRONIC SIGNATURES AND CONTRACTS
Your use of the Website provides you with the ability to enter into agreements electronically and/or to make transactions electronically and via electronic signatures in lieu of wet ink signatures. YOU ACKNOWLEDGE THAT YOUR ELECTRONIC SUBMISSIONS CONSTITUTE YOUR AGREEMENT AND INTENT TO BE BOUND BY AND TO PAY FOR SUCH AGREEMENTS AND TRANSACTIONS. YOUR AGREEMENT AND INTENT TO BE BOUND BY ELECTRONIC SUBMISSIONS APPLIES TO ALL RECORDS RELATING TO ALL TRANSACTIONS YOU ENTER INTO ON the Website, INCLUDING, without limitation, NOTICES OF CANCELLATION, POLICIES, CONTRACTS, AND APPLICATIONS.
CREDIT CARD POLICY
Your credit card transactions and purchase orders are reviewed and verified by our computer software. Your credit card is then charged, and a credit card authorization and verification are placed on the purchase order from our credit card processor. Once your purchase order has been entered through our computer system, a Purchase ID is automatically assigned to your purchase order. A detailed invoice of your transaction along with the Purchase ID will be emailed to you immediately following your transaction. A hard copy invoice is available upon request. RETURN POLICY
Customers purchasing online products or services through the Website shall have no rights to any such product or service your purchase and payment are verified by us. Vet Journey shall not offer any returns or refunds in connection with any product or service purchase, as all such purchases are strictly final sale.
FOR NON-PAYING USERS
NO LIABILITY FOR ACTIONS BY APPLICANTS OR EMPLOYERS
Vet Journey acts only as a venue for employers to post job positions and military candidates to post resumes and does not screen or censor the listings offered. Vet Journey is not involved in the actual transaction between employers and candidates. As a result, Vet Journey has no control over the quality, safety, accuracy, or legality of posted jobs, job listings, profiles, resumes, the ability of employers to offer job opportunities to candidates, and/or the ability of candidates to fill job openings. We are not to be considered to be an employer with respect to your use of the Services or the Website, and we shall not be responsible for any employment decisions, for whatever reason made, made by you or any entity on the Website or made by any job applicant.
NO LIABILITY FOR INACCURACIES ON WEBSITE
The material on the Website may contain inaccuracies or typographical or other errors. Vet Journey makes no representations about the accuracy, reliability, completeness, or timeliness of the material on the Website. Vet Journey cannot and does not confirm that each user is who they claim to be, and Vet Journey has not conducted any verifications of any candidate-supplied data, representations, or information, including, without limitation, background checks, criminal history, drug screenings, job qualifications, employment verifications, driving records, and reference checks. Verification of such data and information is your sole, and use of the Website, the Services, and any information contained therein or derived therefrom is at your own risk. The content of the Website may be updated or revised from time to time at any time, and we have no obligation to provide you any advanced notice of any such update or revision, and these TOS shall apply with equal force to all updates or revisions.
In the event the a Service is listed on the Website or advertised at an incorrect price, Vet Journey shall have the right to refuse or cancel any orders placed for said Service and shall have the right to refuse or cancel any orders made for the Service at the incorrect price, whether or not the order has been confirmed.

If you fail, or if Vet Journey suspects that you have failed, to comply with any of the provisions of these TOS, including but not limited to failure to make payment of fees due, failure to provide accurate and complete registration data, failure to safeguard your account or other personal information, violation of any part of these TOS or the Privacy Policy, or infringement or other violation of third parties’ rights, Vet Journey, at its sole discretion, without notice to you may: (i) terminate your account, in which case you will remain liable for all amounts due under your account up to and including the date of termination; and/or (ii) preclude your or any user’s access to the Website and the Services (or any part thereof). Vet Journey reserves the right to modify, suspend, or discontinue the Website and/or the Services (or any part or content thereof) at any time with or without notice to you, in which case Vet Journey will not be liable to you or to any third party should it exercise such rights.

You agree to indemnify and hold all VJ Parties a harmless from any claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the Website or the Services, including, but not limited to, any content you submit, post to or transmit through the Website, your use of the Services, your violation of these TOS, or your violation of any rights of another.

Any action filed by either party to enforce or construe any right granted under these TOS or to assert any claim arising from your use of the Website or the Services shall be brought exclusively in the city of Fort Mill, SC, USA and the county, state, and federal courts applicable thereto and shall be governed by South Carolina law without regard to its conflict of laws principles. In connection with any such action, you consent to jurisdiction in the courts applicable to Fort Mill, SC and agree to waive any defense or claim of lack of personal jurisdiction, the inappropriateness of venue, or forum non conveniens.
NO WAIVER
No delay, indulgence, or failure to take any action, or exercise any right that Vet Journey may take or exercise pursuant to the TOS, the Privacy Policy or applicable law shall constitute a waiver of that action or right by Vet Journey.
NO ASSIGNMENT
These Terms, and any rights and licenses granted hereunder, may not be transferred, or assigned by you, but may be assigned by Vet Journey without restriction and without your consent, knowledge, or approval. Any attempted transfer or assignment by you in violation hereof shall be null and void.
ENTIRE AGREEMENT
These Terms of Service, the Privacy Policy, and conditions included in the purchase process represent the entire agreement between Vet Journey and you with respect to use of the Website and the Services.
DISPUTE RESOLUTION
Any controversy arising out of or relating to the use of the Website, the Services, or these TOS may at the unilateral election of either us or you be settled exclusively and finally by arbitration. The arbitration shall be conducted in accordance with the commercial arbitration rules created by the American Arbitration Association. All submissions to arbitration shall be made within forty-five (45) days of the date upon which the controversy to be arbitrated arose. The arbitration shall be conducted before a sole arbitrator, and under no circumstance shall punitive damages be awarded in the arbitration. Any award rendered in such arbitration proceedings shall be final and binding on each of the parties, and judgment may be entered thereon in a court of competent jurisdiction.
